1. Scope

These Terms and Conditions apply to all orders placed via the online shop operated by:

By placing an order, the customer agrees to these Terms and Conditions.


2. Contract Formation

The presentation of products in the online shop does not constitute a legally binding offer but an invitation to place an order.

By completing the checkout process, the customer submits a binding offer to purchase the goods in the shopping cart.

The contract is concluded when we accept the order by order confirmation via email or by shipment of the goods.


3. Prices and Payment

All prices are stated in the applicable currency and include statutory VAT where applicable.

Shipping costs are shown separately during the checkout process.

Available payment methods are displayed in the online shop and may include credit card, PayPal, bank transfer, or other payment providers.

Payment is due immediately unless otherwise agreed.


4. Delivery and Shipping

Delivery is made to the address provided by the customer during checkout.

Delivery times stated in the online shop are non-binding unless expressly agreed otherwise.

If delivery is delayed due to force majeure or issues caused by suppliers or logistics partners, we will inform the customer without undue delay.


5. Dropshipping Notice

Some or all products offered in this online shop may be fulfilled via dropshipping or third-party logistics providers.

This means that products may be shipped directly from manufacturers, wholesalers, or external fulfillment partners rather than from our own warehouse.

For the customer, this does not affect contractual rights. Comcrete UG remains the contractual seller and is fully responsible for order processing, customer service, and statutory obligations.

Delivery times may vary depending on the fulfillment location and will be indicated where applicable during the ordering process.


6. Right of Withdrawal (Consumers)

Consumers have a statutory right of withdrawal of 14 days.

Withdrawal Policy

You have the right to withdraw from this contract within 14 days without giving any reason.

The withdrawal period is 14 days from the day you or a third party designated by you receives the goods.

To exercise your right of withdrawal, you must inform us by a clear statement (e.g. email or letter):

Exclusion of Withdrawal for Custom-Made and Personalized Products

The right of withdrawal does not apply to goods that are:

  • manufactured on-demand according to customer specifications, or
  • clearly personalized or custom-made for the customer, including but not limited to commissioned artworks, custom prints, or individually adapted designs.

This applies only where the personalization makes the product uniquely tailored to the customer and unsuitable for resale in its original condition.


Condition of Returned Goods (Non-Custom Products)

For non-customized products, we reserve the right to claim compensation for any loss in value if the goods show signs of handling beyond what is necessary to establish their nature, characteristics, and functioning.

This includes, in particular:

  • scratches, tears, or other physical damage
  • contamination or improper packaging upon return
  • missing components or accessories

Effects of Withdrawal

If you withdraw from this contract (where applicable), we will reimburse all payments received, including standard delivery costs, within 14 days of receiving your withdrawal notice.

We may withhold reimbursement until we have received the returned goods or proof of return shipment.

The customer bears the direct cost of return shipment unless otherwise stated or required by law.

Returned goods must be sent back within 14 days after notification of withdrawal.


7. Retention of Title

The goods remain the property of Comcrete UG until full payment has been received.


8. Warranty

Statutory warranty rights apply.

In case of defects, the customer is entitled to subsequent performance in the form of repair or replacement delivery.

Further rights remain reserved in accordance with statutory provisions.


9. Liability

We are liable without limitation for intent and gross negligence.

In cases of slight negligence, we are only liable for breaches of essential contractual obligations (cardinal obligations), limited to foreseeable damages typical for the contract.

Liability for injury to life, body, or health remains unaffected.


10. Digital Content and Artwork Licensing

For digital content, artworks, prints, or downloadable materials, the following applies:

All intellectual property rights remain with Comcrete UG or the respective rights holder unless explicitly transferred.

Purchases grant a non-exclusive, non-transferable license for personal and private use only.

Commercial use, reproduction, resale, modification, or distribution is strictly prohibited without prior written consent.


11. Custom and Commissioned Artwork

For commissioned or custom artwork:

Unless otherwise agreed in writing, Comcrete UG retains the right to document and display the work for portfolio, marketing, and archival purposes.

13. Governing Law

German law applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).

For consumers within the EU, mandatory consumer protection laws of their country of residence remain unaffected.


14. Online Dispute Resolution

The European Commission provides an Online Dispute Resolution (ODR) platform:

We are not obliged and not willing to participate in dispute resolution proceedings before a consumer arbitration board unless required by law.


15. Final Provisions

If any provision of these Terms and Conditions is invalid, the remaining provisions shall remain unaffected.

Amendments or additions must be made in writing unless legally stricter form requirements apply.
